Terms and Conditions

These Website Terms of Use govern your access to and use of the EDABC website located at edaforblackcommunities.com (the "Site"). By visiting or using the Site, you agree to be bound by these terms. If you do not agree, please do not use the Site.

 

1. Acceptance of Terms

Your access to and use of the Site constitutes your agreement to these Terms of Use and our Privacy Policy, which is incorporated herein by reference. These terms apply to all visitors, users, and others who access the Site, regardless of whether they are registered stakeholders.

2. Use of the Website

You may use the Site for lawful purposes consistent with these terms. You agree to use the Site only in ways that do not violate applicable federal, state, or local laws or regulations.

Prohibited Conduct

You agree not to:

  • Unauthorized access: attempt to gain unauthorized access to any portion of the Site, other accounts, or systems connected to the Site

  • Harmful content: upload, transmit, or distribute any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable

  • Scraping or harvesting: use automated tools to scrape, crawl, or harvest data from the Site without EDABC's express written permission

  • Impersonation: impersonate any person, organization, or entity, including EDABC staff or stakeholders

  • Interference: interfere with or disrupt the operation of the Site or the servers and networks connected to it

  • Malicious code: introduce viruses, malware, or other harmful code to the Site

3. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, program materials, and organizational data — is the property of EDABC or its content providers and is protected by applicable intellectual property laws.

You may view and print content from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without EDABC's express written permission.

4. Third-Party Links

The Site may contain links to third-party websites, including partner organizations, resources, and service providers. These links are provided for your convenience only. EDABC does not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party site. Visiting a linked site is at your own risk.

5. Disclaimer of Warranties

To the fullest extent permitted by law, EDABC, its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if EDABC has been advised of the possibility of such damages.

EDABC's total liability for any claim arising out of your use of the Site shall not exceed one hundred dollars ($100.00).

8. Modifications to the Site

9. Governing Law and Venue

These Terms of Use are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms of Use or your use of the Site shall be brought exclusively in the state or federal courts located in Denver, Colorado. By using the Site, you consent to the personal jurisdiction of those courts.
